1. Overview

Sculpt AI Inc. ("Sculpt," "we," "us") builds an adaptive health platform that integrates training, nutrition, recovery, and wearable data. This Privacy Policy describes how we collect, use, share, and protect information when you use our mobile applications, websites, and related services (the "Services").

By using the Services, you agree to the practices described here. If you do not agree, please do not use the Services.

2. Information we collect

We collect the following categories of personal information:

• Identifiers: name, email address, phone number, account username, device identifiers, IP address.
• Account and profile data: login credentials, authentication tokens, profile photo, preferences.
• Health and fitness data: workouts, sets, reps, exercise logs, nutrition entries, calorie and macro data, body metrics (weight, body composition, measurements), goals, sleep and recovery data, heart-rate data, and data synced from Apple Health, Google Fit, or connected wearables.
• Commercial information:subscription status, purchase history, billing details (payment card information is processed by our payment providers, not stored by us).
• Device and technical data: device model, operating system, browser type, language, time zone, crash logs.
• Usage data: features used, sessions, clicks, in-app events, referrer, pages visited.
• Communications: support messages, survey responses, in-app feedback.
• Inferences: derived insights such as suggested workouts, recovery scores, and nutrition recommendations generated from the above.

3. How we use your information

We use personal information to:

• Provide, personalize, and improve the Services.
• Generate adaptive training plans, nutrition guidance, and recovery recommendations tailored to you.
• Authenticate users and protect accounts.
• Process payments and manage subscriptions.
• Provide customer support and respond to requests.
• Send service communications and, with your consent, marketing messages.
• Analyze usage, debug issues, and improve product quality.
• Detect, prevent, and address fraud or abuse.
• Comply with legal obligations and enforce our Terms of Service.

We process personal data under the following legal bases under GDPR: performance of a contract, your consent, our legitimate interests, and compliance with legal obligations.

4. AI processing of your data

Sculpt uses machine-learning and large-language-model systems to generate personalized training, nutrition, and recovery recommendations. This may include sending de-identified or pseudonymized inputs (such as your recent workouts or goals) to third-party AI providers under data-processing agreements.

• We do not allow our AI providers to train their foundation models on your personal data.
• Outputs from AI systems are recommendations, not medical advice. See our Terms of Service for the health and medical disclaimer.

5. How we share your information

We do not sell your personal information. We share information only in these circumstances:

• Service providers: hosting, analytics, payment processing, customer support, email and SMS delivery, and AI inference. These providers are bound by contract to use data only to provide services to us.
• Connected integrations: when you connect Apple Health, Google Fit, a wearable, or another third-party service, data flows between that service and Sculpt based on the permissions you grant.
• Legal and safety: to comply with law, valid legal process, or to protect the rights, property, or safety of Sculpt, our users, or others.
• Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to confidentiality commitments.
• With your consent: for any other purpose disclosed to you at the time of collection.

6. Health and fitness data

Health and fitness data you provide or sync is treated as sensitive personal information. We use it to personalize your plan and inform recommendations. We do not sell or share it for cross-context behavioral advertising.

Data obtained through Apple Health is used only to provide and improve the Services, is never used for advertising, and is never shared with third parties for marketing purposes, consistent with Apple's HealthKit terms.

Sculpt is not a covered entity under HIPAA, and the Services are not a medical device or clinical tool.

7. Cookies and tracking

Our website uses cookies, SDKs, and similar technologies to remember your preferences, analyze traffic, and measure marketing performance. For a full list of the cookies we use and how to manage them, see our Cookie Policy.

8. Data retention

We retain personal information for as long as your account is active and as long as needed to provide the Services, resolve disputes, and comply with legal obligations. When data is no longer required, we delete or anonymize it.

You may request deletion of your account and associated data by emailing support@sculptai.io or by using the in-app delete-account flow.

9. Data security

We implement administrative, technical, and physical safeguards designed to protect your data, including encryption in transit, access controls, and vendor reviews. No system is perfectly secure. If you believe your account has been compromised, contact us immediately at support@sculptai.io.

10. International transfers

Sculpt is based in the United States. If you access the Services from outside the U.S., your information will be transferred to and processed in the U.S. Where required, we rely on Standard Contractual Clauses or other valid transfer mechanisms to protect data transferred from the European Economic Area, United Kingdom, or Switzerland.

11. Your rights under GDPR

If you are in the European Economic Area, United Kingdom, or Switzerland, you have the right to:

• Access the personal data we hold about you.
• Request correction of inaccurate data.
• Request deletion of your data.
• Restrict or object to processing.
• Port your data to another service.
• Withdraw consent at any time where processing is based on consent.
• Lodge a complaint with your local data-protection authority.

12. Your rights under CCPA/CPRA

If you are a California resident, you have the right to:

• Know what personal information we collect, use, disclose, and share.
• Request deletion of personal information we hold about you.
• Request correction of inaccurate personal information.
• Opt out of the sale or sharing of personal information (we do not sell or share it).
• Limit the use and disclosure of sensitive personal information.
• Not be discriminated against for exercising these rights.

13. Children's privacy

The Services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such data, we will delete it. Users between 13 and 18 must have parental or guardian consent to use the Services.

14. Third-party services

The Services may link to or integrate with third-party services (such as Apple Health, Google Fit, the App Store, Google Play, and payment processors). Those services have their own privacy practices, and we encourage you to review them. Sculpt is not responsible for the content or practices of third-party services.

15. Do Not Track

Our Services do not respond differently to Do Not Track browser signals at this time. You can manage cookies and tracking through the options described in our Cookie Policy.

16. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will notify you by email, in-app notification, or a prominent notice on the website before the changes take effect. The "Last updated" date at the top of this page reflects the current version.
